These terms apply to the Truckies Rest Log iPhone app (the “app”) and the truckiesrestlog.com.au website (the “site”), operated by Opus Novum PTY LTD, Melbourne, Australia (“we”, “us”, “our”). By downloading or using the app, or using the site, you agree to these terms. If you don’t agree, please don’t use them.

1. A companion to your legal records

You must still fill in your National Work Diary (or use an approved electronic system) and keep your legal records as required by the Heavy Vehicle National Law and any other law that applies to you. Records in the app are not evidence of compliance.

2. A tracking aid, not legal advice

The app is a tracking aid. Its countdowns, statuses and warnings are guidance calculated from the times you enter and our reading of the published work and rest rules. They are not legal advice, and they may not reflect every exemption, notice, permit, accreditation condition or change in the law. You are responsible for your own compliance, including checking the official NHVR guidance when you’re unsure.

3. Not a government service

The app isn’t affiliated with or endorsed by the National Heavy Vehicle Regulator (NHVR) or any government agency.

4. Use safely

Don’t use your phone in a way that breaks road rules or distracts you while driving. Set up the app and enter times when you’re safely stopped.

5. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control. The app is also licensed under Apple’s Licensed Application End User Licence Agreement (the Standard EULA). These terms add to the Standard EULA; if they’re inconsistent about the app, the Standard EULA applies to the extent of the inconsistency.

6. Price and the Lifetime unlock

The app is free to download, and Standard Hours is free. The optional Lifetime unlock (BFM, two-up and the other features described in the app) is a one-off A$14.99 in-app purchase. There are no subscriptions or recurring charges. Purchases are made through Apple’s App Store and are subject to Apple’s terms. “Lifetime” means a single payment with no renewal, for as long as we make the app available. The unlock stays linked to the Apple ID used to buy it, and can be restored on your devices through the App Store.

7. Refunds

Purchases are processed by Apple, so refund requests are handled by Apple under its policies.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded.

9. Accuracy and availability

We work hard to keep the app accurate and up to date, but rules change and errors can happen. To the extent permitted by law, we don’t warrant that the app is complete, current, error-free or always available. If something looks wrong, please tell us at support@truckiesrestlog.com.au.

10. Your records

Your records are stored only on your device. You’re responsible for keeping your own copies (for example, by exporting them). We can’t recover records that are deleted or lost with a device.

11. Liability

To the extent permitted by law, and subject to section 8, we aren’t liable for any indirect or consequential loss, or for any fine, penalty, infringement or loss arising from relying on the app instead of your legal records or the law. Where our liability can’t be excluded but can be limited, it is limited (at our option) to supplying the service again or paying the cost of having it supplied again.

12. Intellectual property

The app, the site, and the Truckies Rest Log and Truckies Toolbox names, logos and icons belong to Opus Novum PTY LTD.

13. Changes

We may update these terms from time to time. We’ll post the new version here with a new effective date. Continuing to use the app or site after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
